Democratic Governors Voice Concern Over Health Care Bill

Republican governors are not alone in being concerned about what the proposed health care legislation might mean for their already overstrained budgets: Democrats share the same worries. “We’ve got concerns,” Gov. Jack Markell of Delaware said in an interview Wednesday, hours before getting elected as the chairman of the Democratic Governors Association. “And we’re doing our best to communicate them. We understand the need to get something done, and we’re supportive of getting something done. But we want to make sure it’s done in a way that state budgets are not negatively impacted.”
From the start, Republican governors have been more outspokenly critical about the health care legislation – in particular, the bill proposed by Harry Reid of Nevada, the Senate majority leader – which they said would saddle them with millions of dollars in additional Medicaid costs as insurance coverage is expanded. At their own meeting two weeks ago in Texas, Republican governors declared Democrats felt the same way as they did, but were less apt to say it out of loyalty to President Obama.

Asked about that, Mr. Markell responded: “Perhaps we’ve expressed some of our concerns less publicly. But I believe all governors are certainly concerned about what the potential impact is of some of these bills.”
Mr. Markell said that there was no division between governors and the administration on the need to get some sort of health care bill through; he said that he was reminded of the need in conversations with small businesses struggling with health care costs and constituents who have been unable to get health care coverage. He said his concern was some of the bills being considered would do that by shifting some of the costs to the state – but said he remained confident, after conversations with the White House, that would not be the case.
Whatever the outcome of the health care deliberations, Mr. Markell said he did not believe it would affect the electoral outcome for governors in 2010, a year in which 19 gubernatorial seats currently held by Democrats are on the ballot. The key issues, the governor said, were jobs and the economy.
And to that regard, Mr. Markell said that he was hopeful that the White House and Congress would dispose of the health care deliberations and move on to discussing some sort of jobs creation legislation.
“Right now I believe we need to be focused really significantly on the state level on jobs and on the economic climate overall,” he said. Asked if Mr. Markell thought Mr. Obama and Congress were spending too much time on health care at the expense of the economy, he responded: “Well I feel it would be terrific if they could finish health care and move on.”

When 21 states and several private groups initiated lawsuits challenging the constitutionality of the Obama health care law earlier this year, critics denounced the suits as frivolous political grandstanding. But it is increasingly clear that the plaintiffs have a serious case with a real chance of victory. Easy To Insure ME has the answers
The suits focus primarily on challenges to the new law’s “individual mandate,” which requires most American citizens to purchase a government-approved health insurance plan by 2014 or pay a fine. One of the cases was filed by 20 state governments and the National Federation of Independent Business in a federal court in Florida. Another was initiated by the Commonwealth of Virginia in a federal court in this state, and a third by the Thomas More Law Center in Michigan.
The judges considering the Florida and Virginia cases have both issued rulings rejecting the federal government’s motions to dismiss the suits and indicating that the mandate can’t be upheld based on current Supreme Court precedent. By contrast, Michigan district Judge George Caram Steeh wrote a decision concluding that the mandate is constitutional. But even he agreed that the case raises an “issue of first impression.”
In the most recent of the three rulings, Florida federal District Court Judge Roger Vinson wrote that the government’s claim that the mandate is clearly authorized by existing Supreme Court precedent is “not even a close call.” He points out that “[t]he power that the individual mandate seeks to harness is simply without prior precedent,” because no previous Supreme Court decision ever authorized Congress to force ordinary citizens to buy products they did not want.
An August ruling in the Virginia case by federal District Judge Henry Hudson reached the same conclusion. As Judge Hudson points out, “[n]o reported case from any federal appellate court” has ever ruled that Congress’ powers “include the regulation of a person’s decision not to purchase a product.”
The federal government claims that Congress has the power to impose the mandate under the Commerce Clause, the Necessary and Proper Clause, and the Tax Clause of the Constitution. On the first two claims, Judge Vinson ruled that Supreme Court precedent doesn’t clearly support the government, thereby enabling the plaintiffs’ lawsuit to go forward. He outright rejected the government’s claim that the mandate is constitutional because it is a “tax.” It is instead a financial penalty for refusing to comply with a federal regulation. As Judge Vinson pointed out, congressional leaders consistently emphasized before the law’s enactment that it was not a tax.

In September 2009, President Obama himself noted that “for us to say that you’ve got to take a responsibility to get health insurance is absolutely not a tax increase.” He was right. If the mandate qualifies as a tax merely because it punishes violators with a fine, then Congress could require Americans to do almost anything on pain of having to pay a fine if they refuse. It could, for example, force citizens to buy virtually any product, such as purchasing General Motors cars for the purpose of helping the struggling auto industry.
The government’s Commerce Clause argument is equally dubious. The Clause gives Congress authority to regulate “Commerce . . . among the several states.” But the individual mandate regulates that which is neither commercial nor interstate.
Virtually all purchases of health insurance are intrastate because a combination of state and federal law makes it illegal to purchase health insurance across state lines. Moreover, the object of the mandate isn’t even commerce at all. Instead of regulating pre-existing commerce, the bill forces people to engage in commercial transactions they would have otherwise avoided.
A series of flawed Supreme Court decisions have expanded Congress’ Commerce Clause authority well beyond what the text of the Constitution permits. These rulings allow the federal government to regulate almost any “economic activ ity.” But, as Judge Vinson emphasized, even they do not give Congress the power to regulate people “based solely on citizenship and on being alive.” Far from engaging in “economic activity,” people who decide not to purchase health insurance are actually refraining from doing so.
In his decision in the Michigan case, Judge Steeh argued that the mandate is constitutional under the Commerce Clause because deciding not to purchase health insurance is an “economic decision.”
“Economic decisions,” he reasoned, include decisions not to engage in economic activity. This approach would allow the Commerce Clause to cover virtually any choice of any kind. Any decision to do anything is necessarily a decision not to use the same time and effort to engage in “economic activity.”
If I choose to spend an hour sleeping, I necessarily choose not to spend that time working or buying products. Under Judge Steeh’s logic, the Commerce Clause authorizes Congress to force workers to get up earlier in the morning so that they would spend more time on the job.
Some defenders of the law claim that the individual mandate is similar to federal laws banning racial discrimination against customers by businesses such as motels and restaurants. But federal antidiscrimination laws apply only to existing businesses already engaged in commercial activity in the regulated industry. By contrast, uninsured individuals are not businesses and, by definition, are not participating in the insurance industry.
The federal government also argues that the mandate is authorized by the Necessary and Proper Clause, which gives Congress the power to “make all Laws which shall be necessary and proper for carrying into Execution” other powers Congress is granted by the Constitution.
Even if the mandate is “necessary,” it is not “proper” under our constitutional system of limited federal authority. If the Clause allows Congress to adopt the individual mandate, the same logic would justify almost any other requirement Congress might impose on individuals, thereby gutting the principle of limited federal power.
The legal battle over the mandate is far from over. The Florida and Virginia rulings are not final decisions. Both cases, as well as the Michigan decision, are sure to be appealed to the federal courts of appeals and, ultimately, the Supreme Court.
The anti-mandate plaintiffs still face an uphill struggle. Courts are rarely willing to strike down a law that is a centerpiece of the political agenda of the president and his party. Nonetheless, it is increasingly clear that lawsuits are far from “frivolous” and have a real chance to prevail.

OneWorld Community Health Center is looking for 6,000 kids.
The agency that generally provides health care to the underserved has received 6,264 from the federal government to create a program to enroll thousands of children in either of two government insurance programs for low-income children.
Many metro-area children are eligible but aren’t enrolled because their families don’t know the programs exist or don’t know their kids could qualify, said Andrea Skolkin, chief executive officer of OneWorld. That means some of those children are going without health care or are getting far less than they could.
OneWorld’s goal is to enroll at least 6,000 children. The agency’s outreach effort has just begun.OneWorld will place staff members in day care centers, schools, after-school programs, churches, food pantries, organizations and other places.
“We want to be where people are versus making people come to us,” Skolkin said.
They will contact families at those sites and determine whether they have children who qualify but aren’t enrolled in Medicaid or the state’s Children’s Health Insurance Program.
The staff members will have laptops to take down information and scanners to scan in citizenship documents and proof of Nebraska residency. Children must be citizens to receive the health care benefits.
The agency also will take referrals. For information, call 502-8888.
OneWorld, based in the Livestock Exchange Building, 4920 S. 30th St., has hired a director and will employ five full-time staffers for the program. OneWorld also has a clinic in Plattsmouth.
President Barack Obama this year allocated million to agencies in 42 states and Washington, D.C., for programs to conduct enrollment efforts over the next two years.
Through a competitive process, OneWorld was one of 69 entities to receive money. Iowa doesn’t have a program among the 69. An additional million will be distributed in 2012.
Enrollment among children in Medicaid and the Children’s Health Insurance Program has gradually risen in Iowa and Nebraska. The economy has worsened and awareness of the programs has broadened, spokesmen in Iowa and Nebraska say.
A child qualifies for Medicaid if his family’s annual income is at or somewhat above the federal poverty level, which is ,310 for a family of three.
Qualifying for CHIP isn’t as stringent. In Iowa, the state raised the CHIP ceiling this year to 300 percent of the federal poverty level, or ,930 for a family of three. Nebraska raised its income ceiling for CHIP from 185 percent this year to 200 percent, or ,620 for a family of three.
The Nebraska Department of Health and Human Services has estimated there may be close to 15,000 eligible children who aren’t enrolled. The Iowa Department of Public Health estimated there could be as many as 38,000 children who aren’t covered.

Two moderate Democratic Senators facing re-election battles this year said Tuesday they would oppose using a legislative tool that requires only 51 Senate votes to get health care legislation to President Barack Obama’s desk.
Sen. Evan Bayh, D-Indiana, called the move, known as reconciliation, “ill-advised,” while Sen. Blanche Lincoln, D-Arkansas, issued a news release rejecting the procedure.
“I will not accept any last-minute efforts to force changes to health insurance reform issues through budget reconciliation, and neither will Arkansans,” Lincoln said in the statement.
Both the House and Senate have passed separate health care bills, entirely on support from Democrats.
Democratic leaders were working on merging the two bills, but the nation’s political landscape changed last week when Massachusetts elected Republican Scott Brown to fill the Senate seat held by liberal Democrat Ted Kennedy for almost 47 years until he died in August.
Brown’s victory cost Democrats their 60-seat super-majority in the 100-member Senate necessary to overcome a Republican filibuster. The shift means Republicans can block Democratic initiatives such as health care reform.
Now Democratic leaders are working on a plan for the House to pass the Senate bill, along with a separate package of changes in the Senate plan that reflect compromise between the two chambers.
The package of changes would have to pass both the House and the Senate.
Without the 60-seat super-majority, Senate Democrats now are considering using the reconciliation tool that would require only 51 votes to pass the measure.
However, some Democrats in tough re-election fights worry voters will see that as legislative gimmickry, reinforcing complaints that Democratic control of Washington has been business as usual.
Bayh told CNN that using reconciliation “would destroy the opportunity, if there is one, for any bipartisan cooperation on anything else for the rest of the year.”
Senate Majority Whip Dick Durbin, D-Illinois, dismissed opposition to using reconciliation as a way to get health care legislation to the president.
“I think reconciliation has been used effectively by both parties,” Durbin said. “I wouldn’t walk away from it. It’s an option we should keep on the table.”
Senate Democrats still have 59 votes in their caucus, meaning they could lose eight Democratic votes and still have the 51 needed to pass a health care package through reconciliation.
Still, Democratic sources warn that using reconciliation is complicated and fraught with legislative hurdles, raising questions about whether it could happen even if enough congressional Democrats supported the move.
House Speaker Nancy Pelosi, D-California, emerged from a meeting with Senate Majority Leader Harry Reid, D-Nevada, late Tuesday and said they are making progress on “some kind of package,” but reiterated that at this time “there are not the votes in the House, not anywhere near, to pass the Senate bill.”
Earlier, Reid told reporters there is now “no rush” on health care.
Obama, who made health care his top domestic priority last year, will address the issue in his State of the Union Address on Wednesday, said White House Press Secretary Robert Gibbs.

Gop Claims Health Care Plan Is Merely Camouflage

The White House issued proposals Monday for health care reform that have won kudos from several Democratic lawmakers, a sure sign, say Republicans, of how little GOP input is in the plan.
Republicans have agreed to show up at the White House Thursday for a summit on health care, but are heading there with a dim view of the outcome.
“It’s disappointing that Democrats in Washington either aren’t listening, or are completely ignoring what Americans across the country have been saying,” U.S. Senate Minority Leader Mitch McConnell, R-Ky., said in a written statement.
“House Republicans welcome any good faith effort to start over on health care reform but the bill President Obama unveiled today is just more of the same government-run insurance, mandates and taxes the American people have overwhelmingly rejected,” added Rep. Mike Pence, R-Ind.
The White House, however, insists that the bill is more than just camouflage, but rather represents compromise.
“Senator McCain in the campaign had a proposal to add — to add those dependents on to your parents’ health care up to a certain age to allow for what is a gap in the uninsured based on when someone leaves the dependency of their parents and gets a job that provides health care,” said White House Press Secretary Robert Gibbs, noting that provision has been included in the president’s proposals.
Gibbs argued that 160 Republican amendments were included in varying pieces of legislation that made its way through the House and Senate.
“Inexplicably, all those ideas weren’t good enough,” he said.
Indeed in its effort to appear bipartisan, the White House included in its health care proposals listed on its Web site a section on Republican initiatives that were included in the legislation passed by Congress and included in the president’s latest plan.
Among them were provisions to allow health insurance premiums to vary based on participation in employer wellness programs, grants to states to evaluate medical liability reform ideas, automatic enrollment by employers in health insurance and ability for employees to opt-out.

A federal judge in Virginia will hear arguments Monday on whether the new federal health-care law is unconstitutional.
Virginia Attorney Gen. Ken Cuccinelli II (R) will argue that Congress overstepped its constitutional authority by enacting a provision that requires individuals to purchase health insurance by 2014 or pay a fine. Lawyers for President Obama will tell the judge that the individual insurance mandate falls within Congress’ constitutional authority to regulate interstate commerce.
The lawsuit is one of more than 15 filed across the country challenging the health-care law and one of two state-level attempts to kill the law in the courts. A separate suit filed jointly by 20 states in Florida is moving somewhat more slowly through the court system. A judge ruled Friday that the Florida suit can proceed to trial.
Eastern District of Virginia Judge Henry E. Hudson already rejected a motion from the federal government asking that he dismiss the Virginia case. In a hearing that begins at 9 a.m. Monday, Hudson will hear several hours of arguments directly on the case’s merits.
Hudson is not expected to issue a ruling in the case Monday, but he may indicate when he plans to rule. And he will question lawyers for both sides. The tone and substance of the queries may give some indication of how he views the constitutional dispute.
If Hudson, who was appointed to the bench in 2002 by President Bush, were to rule that the sweeping law is unconstitutional, its national implementation would be halted. However, the Obama administration would likely seek a stay of the ruling while it pursued appeals. Both sides have said they believe the law’s constitutionality will ultimately be resolved by the United States Supreme Court.
In written briefings, Cuccinelli’s lawyers have argued that it would unprecedented to allow Congress to force an individual to make a purchase. Failure to buy insurance, they argue, represents the absence of economic activity and therefore cannot be regulated by Congress as commerce.
U.S. Justice Department lawyers, acting on behalf of Secretary of Health and Human Services Kathleen Sebelius, have countered that a person who decides not to buy insurance has made an economic decision that influences the health care market and can thus be regulated as commerce.
When such people become sick or are injured, the cost of their care is absorbed by the vast health market, lawyers for the federal government say. They also argue that the insurance mandate is key to other provisions of the health-care law. Bringing more healthy premium payers into insurance pools, for instance, will help industry pay the costs of extending insurance to those with pre-existing health conditions, another of the law’s requirements.
At the July hearing, Hudson seemed skeptical of the federal government’s arguments. However, at that phase of the case, the burden was on Justice Department lawyers to show that the Virginia suit was so without merit that it should be tossed from court. In Monday’s hearing, the burden has shifted to Cuccinelli to show that the law is unconstitutional.

Alexander, Corker criticize passage of Senate health care bill

Tennessee Sen. Lamar Alexander released a statement this morning saying the Senate-approved health care bill is riddled with “sweetheart deals” that will increase taxes and damage education.
Fellow Republican, Sen. Bob Corker, said the bill is “fundamentally flawed” and called for bipartisanship.
The bill, approved on a 60-39 vote, must still be merged with legislation passed by the House.
“The Senate health bill will prove to be an historic mistake if this or anything like it is ultimately signed by the president,” said Alexander, who is chairman of the Senate Republican Conference.
“Congress set out to reduce health care costs to Americans and Democrats have managed to do the exact opposite. Their written-in-secret bill will increase health insurance premiums, raise taxes, cut Medicare and dump millions of Americans into Medicaid.
“For Tennessee, Medicaid’s expansion and the bill’s ‘sweetheart deals’ would cost our state more than 0 million over five years when fully implemented, forcing tax increases or damaging higher education—or both.
“Instead, we should start over and move step-by-step to reduce health care costs using the steps that Republicans have repeatedly proposed: let small businesses pool resources for health insurance; allow purchasing of health insurance across state lines; end junk lawsuits against doctors; eliminate waste, fraud, and abuse; expand health savings accounts; and promote wellness and prevention.”
Corker said in his statement, “I’ve spent almost three years and countless hours in bipartisan meetings working toward reforms that would enable all Americans to access affordable, private health insurance.
“I wanted a bipartisan health care reform bill that would stand the test of time. Instead, we were forced to vote on a 2,000-plus page, fundamentally flawed, partisan bill that expands Medicaid by sending billion in unfunded mandates to states, takes 4 billion away from Medicare and leverages it to create a new entitlement, uses budget gimmickry to hide its true cost; increases federal costs, and actually causes Americans to face increased taxes and premiums.
“It’s my sincere hope that Congress returns in 2010 more willing to work in a bipartisan fashion, and my work on financial regulatory reform gives me hope that that’s possible.”

This Week in Health Reform
Republican Scott Brown’s victory over Massachusetts Attorney General Martha Coakley (D) in the January 19 special election to fill the seat of the late Senator Edward Kennedy (D) might prove to be a game-changer for the health care reform debate. The loss of the 60th Democratic vote now robs Senate Democrats of a filibuster-proof majority. Last week, Democrats were rushing to wrap up a House/Senate agreement on the bill, likely due to reports that Coakley’s lead had diminished.
Congressional leaders are still aiming to have the controversial points in the health care reform bill settled as soon as possible, so they can send the compromised bill to the Congressional Budget Office (CBO) for scoring. The CBO will then need 12 days to analyze the legislation.
In addition to Senate Majority Leader Harry Reid (D-NV) and Speaker of the House, Nancy Pelosi (D-CA), lawmakers participating in the White House meetings include: House Majority Leader Steny Hoyer (D-MD), House Majority Whip James Clyburn (D-SC), House Energy and Commerce Committee Chairman Henry Waxman (D-CA), House Ways and Means Committee Chairman Charlie Rangel (D-NY), House Education and Labor Committee Chairman George Miller (D-CA), Assistant Senate Majority Leader Richard Durbin (D-IL), Senate Finance Committee Chairman Max Baucus (D-MT), Senate HELP Committee Chairman Tom Harkin (D-IA), and Senate Banking Committee Chairman Christopher Dodd (D-CT).
A main point of contention between the two houses of Congress pertained to the
40 percent excise tax on high-cost health insurance plans passed by the Senate. Since many labor union members would be affected by the tax on high-cost health insurance plans, the House of Representatives was not supportive of this provision in the Senate bill. Union leaders have also been included in key negotiations on this provision, and on January 14, signaled that they are ready to support the merged legislation with the compromised provision.
The main revenue source for the Senate’s health care reform bill (H.R. 3590) would be from an excise tax – beginning in 2013 – on employer-provided, high-cost health insurance plans costing more than ,500 for individuals and ,000 for a family. The reported compromise on the legislation now makes the tax kick-in on policies costing ,900 for individuals and ,000 for families. The tax threshold would still rise at inflation plus one percentage point, as is currently written in the Senate bill. Additionally, dental and vision benefits would be removed from the calculation of threshold costs, and plans offered by state and local governments, as well as plans covered by collective bargaining agreements, would be exempted from the excise tax until 2018. This would allow current agreements to expire and allow for negotiation of new contracts.
In an effort to make up the lack of revenue from the modification of the excise tax provision, leadership will have to come up with new funding to finance the merged bill. Some reports have mentioned that the pharmaceutical industry has agreed to provide more money than the billion they have already negotiated with the White House. Medical device companies could also face additional fees. Portions of the main revenue source in the House bill – a Medicare payroll tax on wealthy U.S. residents – could be added as well.
On January 14, Richard Trumpka, president of the AFL-CIO, said, “Union leaders approached negotiations with the White House and congressional leaders with one overriding goal in mind – getting a bill signed into law.” Gerald McEntee, president of the American Federation of State, County and Municipal Employees (AFSCME), said, “We do like the way it’s shaping up, but it’s still not finished. We’ve got to see a final product.”
There also has been significant discussion – but no resolution so far – about the question of whether to establish a single national health insurance exchange or allow each state to operate its own exchange. Blue Cross and Blue Shield of Texas continues to support a state-based approach to exchanges.

The sudden halt to health care reform’s steady march forward came as a shock to many who saw an upset win by Republican Senator-elect Scott Brown in Massachusetts as all but impossible. But if many took delight in the election outcome’s impact on health reform legislation, Aetna Chairman Ronald A. Williams made it clear in a New York Times story last week that the country still needs meaningful health care reform – reform that addresses access as well as affordability. Everyone benefits by health reform that gets at the factors driving soaring health care costs and the loss of coverage for so many Americans. While Congress thinks carefully about its next steps, Aetna will continue to support meaningful health care reform and continue to offer responsible solutions to legislative leaders.

The election of Republican Scott Brown as the new senator from Massachusetts has derailed the Congressional health care reform train, less because Brown denies Democrats the 60th filibuster-proof vote, though that is certainly a major result, and more because it collapsed the Democratic political house of cards by highlighting the power of independent voters and the frustrated anti-incumbent mood of the electorate. Whether Democrats can regroup from this wake-up call will consume their leadership from now until the November off-year elections. How Democrats handle, and how Republicans respond to, health care reform in the short term and other key priorities – such as jobs, the economy, energy and security – over the rest of the session will underscore all Congressional decisions from now until the first Tuesday in November. In short, the 2010 elections started in earnest with Brown’s victory.
Once Democrats get past the shock of losing Kennedy’s seat, they will have to grapple with health care reform, one way or the other. The early favorites, including passing the Senate bill “as is” in the House, have been dropped for now as Democrats recognize the political cost of ramming through something unpopular propelled by political muscle only. Passing a smaller, less invasive and mostly Democratic bill has only a slightly better chance, as Republicans are not too likely to “crossover” quite yet. There is a growing interest in using reconciliation (the 51-vote tactic) down the road to pass a Democratic-only bill, once the House and Senate Democratic leadership can agree to a single bill. And, there is the outside chance that Democrats will see the Massachusetts election as an imperative to craft a bipartisan bill with Republicans that can secure 70-plus votes in the Senate. Wednesday’s State of the Union speech, followed by the party issues retreats later in the week, will go a long way toward determining which path will be pursued.

Brown Vows To Send Health Care Reform ‘back To The Drawing Board’

Republican Scott Brown, fresh off his victory in the Massachusetts race for U.S. Senate, called on the secretary of state to send him to Washington immediately, saying Wednesday that he wants to send health insurance reform “back to the drawing board.”
Though the state typically waits at least 10 days to collect absentee ballots before certifying, the senator-elect said he’s “confident” his margin of victory — 5 points and nearly 110,000 votes — was greater than the number of outstanding ballots.
Brown is champing at the bit to be sworn in since he would become the 41st Republican in the Senate, breaking the Democrats’ 60-vote supermajority and potentially scuttling health care reform if it returns to the chamber for a final vote.
“Since the election is not in doubt, I’m hopeful that the Senate will seat me on the basis of those unofficial returns,” Brown said, adding that he’s already spoken to members of the state’s congressional delegation, including Sen. John Kerry, and will travel to Washington Thursday. “I think it’s important that we hit the ground running because there’s some very important issues facing our country.”
On health care reform, he said he wants “everyone” to have some form of health care coverage, but questioned plans to slash Medicare and raise taxes to do it.

“I think we can do it better,” he said.
The Republican senator-elect said he was focused on moving to Washington as soon as possible to try to free up some of the political gridlock there.
“I have always just wanted to go down and solve the problem regardless of party,” Brown told NBC’s “Today” Show.
“While they’re in Washington talking about what someone said in a book and what this happened, we have some very serious problems when it comes to over-taxation, overspending and Al Qaeda who are trying to kill us. So we need to get back to the basics and start solving problems that affect every person in this country,” he said.
Brown’s insurgent candidacy has forced Democrats to rethink the basics on several matters, including the massive health insurance reform bill that is tagged to cost nearly trillion over 10 years. They are also reconsidering agenda items they plan to use in November’s midterm election campaigns.
By winning the Senate seat in Massachusetts by nearly the same margin that President Obama defeated Sen. John McCain in November 2008, Brown takes away Democrats’ filibuster-proof majority and can pull a reverse-Obama — claiming a mandate to defeat the health care legislation now stuck in Congress.
Despite the upset, Obama adviser David Axelrod said administration officials will take into account the message voters delivered Tuesday but declined to go further.
“It’s not an option simply to walk away from a problem that’s only going to get worse,” Axelrod said of the health care bill.
Sen. Susan Collins, R-Maine, said one of the many messages coming out of the Massachusetts election is that Americans are sick of partisan gridlock, but voters also had a much more expansive recommendation.
“They want better performance out of Washington, they want us focusing on the troubled economy and the need for more jobs and … they’re tired of sweetheart deals that were sneaked into the health care bill. They want that kind of bill to be negotiated in the open. And they’re tired of politics as usual and they also want controls. They don’t want unfettered, one-party control,” Collins told Fox News.
Collins said she cannot support a bill “that imposes billions of dollars for new taxes, slashes Medicare by 0 billion and would actually cause insurance rates to go up.”

But Pennsylvania Gov. Ed Rendell said that Americans oppose the health insurance changes because “the administration and its supporters, myself included, haven’t done a good enough job explaining to people what’s in this bill.”
Rendell said he wants to go back to the drawing board in order to better communicate the message. If that fails, and a filibuster is threatened, then Democrats shouldn’t “just cave” but should make the other side “explain why they’re trying to block the bill with this type of political chicanery.”
“I haven’t heard one good alternative offered by any Republican except let’s start at the beginning, let’s start all over. Start all over to do what?” he asked.
Rendell added that he wants to call the GOP’s bluff.
“Let them filibuster, let them take to the floor and speak endlessly and endlessly about why this is bad for the American people and what the alternative is,” he said.
As the debate continues over whether to scrap the year-long health insurance reform effort, some are also looking at whether Republicans can repeat the feat in Massachusetts in other states.
Seven Senate seats now held by Democrats are now considered toss-ups in November — Nevada, Colorado, Arkansas, Illinois, Pennsylvania, Delaware and Connecticut. Four Republican seats are in the same situation — Missouri, Kentucky, Ohio and New Hampshire.
“I think anybody who’s up for election this November ought to take seriously what the people of Massachusetts had to say in that special Senate election,” said Sen. Joe Lieberman. D-Conn.
Sen. John Cornyn, R-Texas, head of the National Republican Senatorial Committee, said Democrats nationwide should be on notice
“Americans are ready to hold the party in power accountable for their irresponsible spending and out-of-touch agenda.”
But Democratic Senatorial Campaign Committee Chairman Robert Menendez cautioned against “taking a single unique election and extrapolating what it means for the midterms 10 months away.”
Still, Menendez said he doesn’t want to sugarcoat what happened and Democrats will be sorting through the lessons in the days ahead.
